Welcome to MashrakhBazzar (“MashrakhBazzar”, “we”, “our”, or “us”).

These Terms and Conditions (“Terms”) govern your access to and use of the MashrakhBazzar website, mobile application, and related services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.

1. Eligibility

To use MashrakhBazzar, you must be legally capable of entering into a binding contract under applicable law.

Persons who are not competent to contract under applicable law, including minors, may use the Platform only under the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms.

Users are prohibited from purchasing any products whose sale is restricted by law based on age or other eligibility requirements.

By using the Platform, you represent and warrant that:

• The information you provide is accurate and complete
• You will comply with these Terms and applicable laws
• You are authorized to use the payment method selected

2. User Account

You are responsible for:

You must notify us immediately if you suspect unauthorized access.

MashrakhBazzar is not responsible for losses arising from unauthorized access caused by user negligence.

MashrakhBazzar provides a digital commerce platform enabling users to:

• Add products to cart
• Place orders
• Make payments
• Schedule deliveries
• Contact customer support

Service availability may vary based on:

• Location
• Inventory
• Operating hours
• Delivery capacity
• Technical availability

We reserve the right to modify, suspend, or discontinue services without prior notice.

4. Serviceable Areas

MashrakhBazzar currently operates only in selected serviceable locations.

Delivery availability depends on:

• Delivery zone
• Distance
• Operational capacity
• Weather and local conditions

Even after order placement, we reserve the right to cancel an order if delivery to the provided address is not feasible.

Serviceable areas may change at any time.

5. Product Listings and Availability

We strive to keep product information accurate, including:

• Product names
• Descriptions
• Images
• Pricing
• Offers
• Availability

However, errors may occur.

Product images are for illustrative purposes only. Actual packaging, labeling, or appearance may differ.

Products are subject to availability at the time of processing.

Adding a product to cart does not reserve inventory.

6. Pricing and Charges

All prices are displayed in Indian Rupees (INR) unless otherwise stated.

Charges may include:

• Delivery fee
• Platform fee
• Handling fee
• COD charges (if applicable)
• Taxes (if applicable)

Prices may change without prior notice due to:

The final payable amount will be displayed at checkout.

7. Orders and Acceptance

Placing an order constitutes an offer to purchase.

Order acceptance is subject to:

MashrakhBazzar reserves the right to:

• Accept orders
• Reject orders
• Cancel orders
• Limit order quantity

Reasons may include stock shortage, suspicious activity, pricing errors, or technical issues.

8. Partial Fulfillment and Substitutions

Certain products may become unavailable after order placement.

In such cases, MashrakhBazzar may:

• Remove unavailable items
• Partially fulfill the order
• Suggest equivalent replacements (where applicable)
• Refund unavailable items

You will only be charged for fulfilled items.

9. Fresh Produce and Weight Variance

For products sold by weight, including but not limited to:

• Fruits
• Vegetables
• Meat
• Grains
• Loose grocery items

Actual delivered weight may vary slightly from displayed weight due to packaging and handling.

Reasonable weight variance shall not be treated as product defect.

Final billing may be adjusted where applicable.

10. Payments

We may support payment methods including:

• UPI
• Cash on Delivery (COD)
• Other digital payment methods

Users agree to pay all applicable charges.

Payments may be processed through third-party payment providers.

MashrakhBazzar does not store sensitive credentials such as:

• Card PIN
• CVV
• UPI PIN
• Banking passwords

Payment failures may result in incomplete or cancelled orders.

11. Cash on Delivery (COD)

COD is available only for eligible orders and serviceable locations.

MashrakhBazzar reserves the right to:

• Restrict COD
• Disable COD for certain users
• Apply COD fees
• Limit COD order value

Repeated misuse, including:

• Fake orders
• Refusal to accept delivery
• Non-payment
• Repeated failed deliveries

may lead to account restrictions or suspension.

12. Delivery

Estimated delivery times are approximate and not guaranteed.

Delivery may be affected by:

• Weather
• Traffic
• High demand
• Operational issues
• Address problems
• Government restrictions

Users must provide accurate delivery details.

Additional charges or cancellation may apply for failed deliveries caused by incorrect address or unavailability.

13. Delivery Completion

An order shall be considered successfully delivered when it is:

• Handed to the customer, or
• Delivered to a family member / authorized recipient, or
• Delivered at the delivery location as instructed by the customer

Risk and responsibility for products transfer upon successful delivery.

14. Cancellation

User Cancellation

Orders may be cancelled before processing or dispatch, subject to operational feasibility.

Platform Cancellation

MashrakhBazzar may cancel orders due to:

• Stock unavailability
• Pricing errors
• Payment issues
• Fraud detection
• Delivery limitations
• Technical issues

Refund eligibility depends on order status at cancellation time.

15. Returns, Replacements, and Refunds

Refunds, returns, or replacements may be permitted for eligible issues such as:

• Damaged product
• Wrong product
• Missing item
• Expired product
• Defective product

Claims must be reported within a reasonable time after delivery.

Certain products may be non-returnable, including:

• Perishable goods after acceptance
• Opened consumables
• Products damaged after delivery due to customer handling

Approved refunds will be processed to:

• Original payment source, or
• Alternative approved refund method

Refund processing timelines depend on banks and payment providers.

16. Promotions and Offers

Discounts, coupons, referral benefits, and promotional campaigns are subject to separate terms.

We reserve the right to:

• Modify offers
• Withdraw offers
• Reject suspicious usage
• Limit redemptions

Offer abuse may result in account suspension.

17. User Communications Consent

By using MashrakhBazzar, you consent to receiving communications related to the Platform through:

• Push notifications

These communications may include:

• OTP verification
• Order updates
• Delivery notifications
• Payment confirmations
• Support communications
• Promotional offers (where permitted)

You may opt out of promotional communications where applicable.

18. Prohibited Conduct

Users must not:

• Use fake identities
• Abuse offers or promotions
• Place fraudulent orders
• Attempt unauthorized access
• Reverse engineer the Platform
• Disrupt services
• Harass delivery personnel or staff
• Violate applicable laws

Any such activity may result in restriction, suspension, or termination.

19. Intellectual Property

All rights relating to the Platform, including:

• Logos
• Branding
• Software
• Content
• Text
• Graphics
• Design

are owned by MashrakhBazzar or its licensors.

Unauthorized use is prohibited.

20. Third-Party Services

The Platform may integrate third-party services including:

• Payment gateways
• Maps services
• Cloud infrastructure
• Notification providers
• Analytics services

MashrakhBazzar is not responsible for outages, errors, or policies of third-party services.

21. Limitation of Liability

To the maximum extent permitted by law, MashrakhBazzar shall not be liable for:

• Indirect damages
• Loss of profits
• Business interruption
• Data loss
• Delayed deliveries
• Third-party service failures

Services are provided on an “as available” and “as is” basis.

22. Indemnity

You agree to indemnify and hold harmless MashrakhBazzar against claims arising from:

• Misuse of the Platform
• Violation of these Terms
• Fraudulent activity
• Violation of applicable law

23. Suspension and Termination

We may restrict, suspend, or terminate access without prior notice if we reasonably believe you have engaged in:

• Fraud
• Fake orders
• COD abuse
• Security abuse
• Illegal activity
• Serious policy violations

24. Force Majeure

MashrakhBazzar shall not be liable for delays or failures caused by events beyond reasonable control, including:

• Natural disasters
• Floods
• Fire
• Internet outages
• Government restrictions
• Pandemic disruptions
• Civil disturbances

25. Changes to Terms

We may revise these Terms periodically.

Updated versions will be published on the Platform.

Continued use after updates constitutes acceptance of revised Terms.

26. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of competent courts in Bihar, India.
